APPLICATION FOR CONSTRUCTION PERMIT

Prior to commencement of a construction work, it is essential to have a building permit, LH.LLC provides a procedures 

for obtaining a Building permit.

1. The following documents are required to obtain a building permit:


- Certificate of land use right (Red paper) for building the house on the blank ground.

- Certificate of the dwelling house use right and residential land use right (Pink paper) or certificate of house ownership for building the house on the old floor.

- The decisions on land allocation or land lease by the competent state authority.

- A temporary land use right certificate issued by a competent authority or listed in the cadastral book without any dispute.

- The papers was issued by the competent agency of the old regime (including: a field title-deed or excerpts, extraction of field maps, map of subdivisions, the notarized sold certificate, the registered certificate and the certificate of name change at notary Office, Land service, Registry Office).

- The inheritance certificate of the house or land is certified by the commune People's Committee as inheritance, without any dispute.

- The judgment or decision of the People's Court or the decision of resolving the land dispute has taken legal effect.

- The documents of land transfer, sale and purchase of dwelling house together with the right to use residential land were confirmed by the people's committee of ward / commune / town, district/ suburban district without any dispute.


2. A dossier of application for a building permit to a new house is prescribed as follows:


The dossier of application for a new building permit is made in three sets and submitted to the People's Committee of district/ suburban district including:


- Application for building permit (as form) under the owner's name.

- A notarized copy of one of document as a land use right certificate, enclosed with the extract of the land map or field measurement, specifying the diagram of the land plot boundary, the elevation and the rate of cadastral regulations.

- A business registration certificate (for construction works of the enterprise).

- A design dossiers include: The ground plan of the work on the land plot with the rate of 1/200-1/500, the plan of the project location, floor plan, vertical and cross section of the work with the rate of 1/100, foundation’s ground plan, and cross section of foundation’s ground in detail, water supply and drainage diagrams, electricity.


3. The issuance authorities of building permit:


The Chairman of the People's Committee of district/ suburban district licensed the construction of houses and works with a floor area up to 1,000 m2 or an investment cost up to $VND 2 billion, the larger works licensed by the City Department of Construction. The maximum issuance time is 30 days from the date of receipt of a complete and valid file. After 30 days without a permit or a refusal opinion of the licensing agency, the applicant shall send a written notice to the People's Committee of ward and be entitled to start the construction without a permit.


4. Extension of the building permit:


Within 12 months from the date of obtaining the building permit, the work has not been started, the applicant is entitled to extends, and the extension period is 12 months. An extension dossier comprises: The extension application of construction permit (as form), the original of granted building permit. The renewal license period is 10 days


5. The procedures for completion of the work are regulated as below:


Once the construction is completed, the landlord must submit an application of completed work. The licensing agency is also the issuing agency of the completion report. The profile of completed work includes:


- Notice of request for inspection of completed works (as form).

- Copy of the building permit.

- A copy of the construction contract with a contractor with a legal body (notarized).


6. Asking for permission to repair, renovate or expand an individual’s private house.


The application for a repair license is made in 3 sets and submitted to the People's Committee of district/ suburban district including:


- Application for building permit (as form) under the owner's name.

- A notarized copy of one of document as a land use right certificate and house ownership right (if any), enclosed with the extract of the land map or field measurement, specifying the diagram of the land plot boundary, the elevation and the rate of cadastral regulations.

- A business registration certificate (for construction works of the enterprise).

- A design dossiers include


The ground plan of the work on the land plot with the rate of 1/200-1/500, the plan of the project location, floor plan, vertical and cross section of the work with the rate of 1/100, foundation’s ground plan, and cross section of foundation’s ground in detail, water supply and drainage diagrams, electricity.


- The photos of main face of the repaired house and 2 houses on both sides (size 9x12).

- The files on the current survey of the foundation (determining the ability to upgrade the floor and reinforcement measures) of advisory organization with the legal body (in case of upgrading the floor).
